Is Blue Lotus Legal? U.S. State Laws & Worldwide Status (2026)

Author: Neil Emmett

Quick answer: Yes, blue lotus (Nymphaea caerulea) is legal to buy, sell, and drink as a tea in most of the United States. It is not a controlled substance under federal law. The main exceptions are Louisiana, which restricts blue lotus products meant to be consumed or smoked, and the U.S. military, which prohibits service members from using it. Several countries, including Poland, Latvia, and Russia, also restrict it. Details below, current as of September 2026.

Is blue lotus legal federally?

Blue lotus does not appear on any schedule of the federal Controlled Substances Act, and the DEA does not list it as a controlled substance. That is why you can find blue lotus tea sold openly online and in shops across most of the country.

Being legal is not the same as being FDA-approved. The FDA has not evaluated or approved blue lotus to treat any condition. Products that make medical claims can draw FDA enforcement, which is why reputable brands sell blue lotus as an herbal tea and avoid promising cures. Blue lotus products are also not individually reviewed by the FDA before sale, so quality depends on the seller. The University of Virginia's poison center notes that tested products vary widely in strength, and some contain little active material at all.

Where is blue lotus illegal in the U.S.?

Louisiana

Louisiana is the only state we are aware of with a specific law on blue lotus. Under Louisiana Revised Statutes 40:989.2, it is unlawful to produce, manufacture, distribute, or possess products containing Nymphaea caerulea (listed as "Blue Lotus, Egyptian Lotus") when they are intended to be put in the mouth or nose, prepared for smoking, or burned and inhaled. The same law covers several other botanicals, including sacred lotus (Nelumbo nucifera), damiana, and mugwort.

The statute includes exceptions for plants grown strictly for aesthetic, landscaping, or decorative purposes, for certain FDA-recognized homeopathic drugs, and for dietary supplements labeled and manufactured under federal law. Penalties for distribution can reach five years in prison and a $10,000 fine, and simple possession can bring up to six months in jail and a $500 fine. If you live in Louisiana, do not order blue lotus tea.

The U.S. military

Blue lotus is on the Department of Defense Prohibited Dietary Supplement Ingredients list. Active-duty service members should not buy or use it in any form.

Everywhere else

As of this update, the other 49 states do not have laws that specifically ban blue lotus tea. Local rules and new legislation can change, so check your state and city if you are unsure, especially before selling it.

Is blue lotus legal in other countries?

Why is blue lotus restricted anywhere?

Blue lotus contains alkaloids, mainly apomorphine and nuciferine, that act on dopamine and serotonin receptors and can produce mild relaxation and mood changes. Concentrated extracts, resins, and vapes are much stronger than tea, and poison centers have documented side effects from them. A 2024 study in the Journal of Analytical Toxicology also found synthetic cannabinoids in some vaping products sold as blue lotus. Lawmakers who restrict it are usually responding to those concentrated and inhaled products. Learn more in our guide to blue lotus effects.

Will blue lotus show up on a drug test?

Standard workplace drug panels do not test for blue lotus alkaloids. The bigger risk is contamination: products adulterated with synthetic cannabinoids or other drugs can cause positive results. That is another reason to choose single-ingredient tea with third-party lab testing. See how long blue lotus stays in your system for more.

Why do some blue lotus products say "not for human consumption"?

Some sellers label blue lotus as incense, potpourri, or "not for human consumption" to avoid food regulations, or because the product was not made to food standards. If you plan to drink it, choose a product sold and labeled as an herbal tea, ideally certified organic and lab tested.

How to buy blue lotus legally and safely

  1. Confirm blue lotus is legal where you live, and do not buy it if you are in Louisiana or serving in the military.
  2. Buy from a U.S. company that sells it as a tea and lists the botanical name, Nymphaea caerulea.
  3. Ask for third-party lab results for identity and contaminants.
  4. Avoid products that promise a "high" or medical cures.

Our guide to buying blue lotus tea walks through the full checklist. Delta North Blue Lotus Tea is sold as a USDA Organic herbal tea, made from 100% Nymphaea caerulea flowers, with every batch third-party tested.
